Terms of service
Effective date: October 15, 2026
These terms apply when you use maritimeburials.com or the Maritime Burials app to book a charter or buy from our memorial store. "We" and "Maritime Burials" mean Maritime Burials, LLC. By booking or ordering, you agree to these terms.
1. What Maritime Burials does
Maritime Burials is a marketplace. We list privately operated, captained vessels; we pass your inquiries to captains; and we take payment and pay captains after each trip. Each trip is run by an independent captain or charter company, who is responsible for the vessel, crew and the conduct of the service at sea. We do not own or operate the vessels.
2. Booking a charter
•
Every booking starts as an inquiry. The captain replies with a written offer stating the date, start time, total price and any add-ons.
•
A booking is confirmed only when you accept the offer and your payment succeeds.
•
Please give accurate information about your party, including the number of guests and any accessibility needs, so the captain can plan safely.
3. Prices, fees and payment
•
You pay the charter price set by the captain plus a Maritime Burials booking fee of 11.5%. Both are shown before you pay.
•
Payments are processed by Stripe. We do not store your full card details.
•
Gratuities for the captain and crew are optional and not included.
4. Changes and cancellations
•
Reschedule first. If weather, the vessel or anything else prevents a trip, the captain offers new dates.
•
If you cancel and no new date is agreed, you are refunded the charter price less the booking fee and card processing costs (about 3%).
•
If the captain cancels and you accept none of the new dates offered, you receive a full refund, including the booking fee.
•
Maritime Burials may step in to resolve a dispute and may issue refunds under this section.
5. Weather and safety
The captain has final authority over whether conditions are safe to go out and over safety aboard the vessel. Please follow the captain's and crew's instructions at all times. A trip postponed for weather or safety is rescheduled under section 4.
6. Burial at sea rules
Services follow the EPA general permit for burial at sea (40 CFR 229.1) and the state and local rules where the vessel operates. Ocean scatterings take place at least three nautical miles from land, and only decomposable materials may go into the water. You are responsible for bringing any paperwork your state requires, such as the permit for disposition that usually comes from your funeral home or crematory. Our scattering rules pages summarize these rules but are not legal advice.
7. Store purchases
Products from our memorial store are covered by our Store Returns and Refunds policy. Some products are made or shipped by our suppliers.
8. Reviews and messages
Reviews and messages must be honest and respectful. We may hold back or remove content that is abusive, false or includes private information. Messages on the platform help us resolve any dispute, so please keep booking arrangements there.
9. Limitation of liability
To the fullest extent permitted by law, Maritime Burials is not liable for the acts or omissions of independent captains and charter operators, or for indirect or consequential losses. Our total liability for any booking or order is limited to the amount you paid us for it. Nothing in these terms limits liability that cannot be limited by law.
10. Governing law
These terms are governed by the laws of the State of California. Disputes will be handled in the courts of San Diego County, California, unless the law where you live requires otherwise.
11. Changes to these terms
We may update these terms. The version posted when you book or order applies to that booking or order.
